American Lawyer Media Publishes 19th Edition of Insurance Bad Faith in Pennsylvania by Post & Schell Insurance Group Chair Richard McMonigle

Philadelphia, PA – March 13, 2019 – American Lawyer Media (ALM)/The Legal Intelligencer have published and released the 19th Edition of Insurance Bad Faith in Pennsylvania, the authoritative resource for attorneys, judges, and claims professionals addressing insurance bad faith cases in the Commonwealth of Pennsylvania. The book, first published in 1999, is authored by Post & Schell Principal and Insurance Law Department Chair Richard L. McMonigle, Jr.

With forewords by Hon. Edward N. Cahn (Ret.) and Joseph R. Roda, Esq., the 19th edition examines every important issue relating to bad faith lawsuits under Pennsylvania's common law and under §8371- Pennsylvania's "Bad Faith Statute."

“For over a quarter century, Pennsylvania’s law relating to claims of insurance bad faith has been a dynamic and fast-changing area,”  said Mr. McMonigle. “Insurance permeates nearly every aspect of business and individuals’ personal lives. When an insured submits a claim, the insurer’s obligation to investigate the claim in good faith and arrive at the right decision is of paramount importance. Insurance claims generate a lot of litigation in Pennsylvania, and my book tries to organize and make sense of it all.”

The 19th Edition of Insurance Bad Faith in Pennsylvania includes:

  • Over sixty (60)  new court opinions briefed and discussed
  • Summaries of all significant bad faith cases, organized by category
  • An update regarding the Superior Court’s overturning the $18 million punitive damages award in Berg v. Nationwide Ins. Co.
  • Discussion of the latest developments in auto and homeowner’s bad faith claims
  • Analysis of claims seeking recovery of compensatory and consequential damages
  • Strategic considerations in presenting, and defending against, bad faith claims
  • An updated Verdict Index, summarizing all bad faith trial verdicts in Pennsylvania

Mr. McMonigle’s national insurance practice focuses upon the defense and trial of first and third party insurance matters involving coverage issues, allegations of bad faith, and claims of policyholder fraud.  A veteran litigator, he also provides training to claims professionals and attorneys on the subject of good faith claims handling. He also serves as a voluntary mediator and expert legal consultant in insurance disputes where bad faith is alleged.

In addition to authoring Insurance Bad Faith in Pennsylvania, Mr. McMonigle is the co-author of ALM’s Insurance Bad Faith in New Jersey, now in its 4th Edition, the authoritative single-volume collection of New Jersey law on bad faith litigation.
